Terms of Service

The deal
These Terms of Service govern your use of Connect Predict’s website and service (the “Service”). By requesting a pilot, uploading a list or otherwise using the Service, you agree to these Terms on behalf of yourself and the company you represent. If you do not agree, do not use the Service.
What the Service does
Connect Predict scores contact lists for how likely each phone number is to be answered, using carrier activity checks and live verification calls. We return a file with an Answer Probability, what we found and the date we checked. We also monitor your outbound numbers for spam labels and, if you ask, can source contacts in your ideal customer profile. The Service may change over time.
Free pilot
A pilot scores up to 250 contacts at no charge. It is limited to one pilot per company and US numbers only. We may decline or limit a pilot, for example if we believe it is being misused.
Pricing and payment
Fees are 15¢ per contact, with a minimum of 500 contacts, unless we agree otherwise in writing. A monthly plan is available at 12¢ per contact with priority processing and renews automatically each month until you cancel. Fees are in US dollars and exclude taxes. Unless we say otherwise in writing, there are no seat fees and no long-term contracts. Fees are non-refundable except where required by law.
Your data
You own the contact lists and other content you upload (“Customer Data”). You give us a limited right to use Customer Data to provide the Service to you. You are responsible for having the right to upload Customer Data and for making sure doing so complies with applicable law. We handle Customer Data as described in our Privacy Policy.
Verification calls
To score a number, we place brief verification calls handled by a live person, during business hours, with a truthful caller ID. We do not pitch, and we do not tell the person we call who uploaded the number. If someone asks not to be contacted, we suppress their number.
Your responsibilities
Follow the law in your outreach
You are solely responsible for how you use the results, including compliance with laws that govern calling and messaging, such as telemarketing, do-not-call, consent and caller ID rules.
Use the Service responsibly
Do not use the Service to harass anyone, to place unlawful automated or spoofed calls, to break the law, to interfere with the Service, or to resell or reverse engineer it.
Results are estimates
Answer Probability ratings and connect rates reflect answering behavior we observe at the time of a check. They are estimates, not promises. Actual results depend on your list, persona, caller ID, timing and how your team calls.
Ownership
We own the Service, including its software, scoring methods and the Answer Probability ratings. We give you a non-exclusive, non-transferable right to use the results we return for your internal business purposes. If you give us feedback, we may use it without obligation to you.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limit of liability
To the fullest extent permitted by law, Connect Predict will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.
Indemnity
You will defend and indemnify Connect Predict against claims, losses and costs arising from your Customer Data, or from your use of the Service or the results in breach of these Terms or applicable law.
Ending these Terms
You can stop using the Service at any time. We may suspend or end your access if you breach these Terms or if we are required to by law. Sections that by their nature should survive ending these Terms will do so.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. The state and federal courts located in New York County, New York have exclusive jurisdiction over any dispute.
Changes
We may update these Terms. When we do, we will change the date at the top of this page. By continuing to use the Service after a change, you accept the updated Terms.
